These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Elevate Business Operations LLC, doing business as Elevate Operations ("Elevate Operations," "we," "us," or "our") governing your access to and use of https://elevateops.io (the "Site") and any related services, tools, and content we provide (collectively, the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

Elevate Operations provides monday.com consulting, implementation, and managed services, including but not limited to workflow design, platform configuration, training, and ongoing operational support. Specific scope, deliverables, and fees for any engagement are governed by a separate signed agreement (such as a Master Service Agreement or Statement of Work) between Elevate Operations and the client.

These Terms apply generally to use of the Site and to communications with Elevate Operations, and do not replace or override the terms of any signed client agreement.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, local, or international law
• Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems connected to the Site
• Use any automated system (bots, scrapers, etc.) to access the Site without our prior written consent
• Interfere with or disrupt the operation of the Site or servers/networks connected to it
• Transmit any material that is defamatory, obscene, or otherwise objectionable

All content on the Site — including text, graphics, logos, images, and software — is the property of Elevate Operations or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

By providing your phone number or email address to Elevate Operations (including through a form on the Site, during a sales call, or as part of an active client engagement), you consent to be contacted by Elevate Operations via phone, email, and SMS/text message regarding your inquiry, appointments, account updates, and related business communications.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors or vendors that facilitate our services (e.g., SMS gateway providers) is permitted for purposes of providing the requested services, in accordance with our Privacy Policy.

Carrier and messaging service liability: Carriers are not liable for delayed or undelivered messages.

Fees for consulting, implementation, and managed services engagements are set forth in the applicable signed agreement or invoice between Elevate Operations and the client. Unless otherwise stated in that agreement, invoices are due upon receipt, and late payments may be subject to a late fee and/or suspension of services.

The Site may contain links to third-party websites or reference third-party platforms (such as monday.com, Aircall, or other tools) that are not owned or controlled by Elevate Operations. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is governed by those parties' own terms.

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Elevate Operations does not warrant that the Site will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Elevate Operations and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to Elevate Operations, if any, in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Elevate Operations and its officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Davis County, Utah.
